The HOA enforces rules and regulations designed to maintain property values and community standards while providing various services and amenities to residents.

The Benefits of HOA Living

Maintained Property Values HOAs work to preserve and enhance property values through consistent maintenance standards and architectural guidelines. This protection can be especially valuable in resort communities throughout the Grand Strand, where curb appeal directly impacts investment returns.

Community Amenities Many HOA communities offer attractive amenities such as pools, fitness centers, golf courses, walking trails, and clubhouses. These facilities would be expensive to maintain individually but become affordable when shared among community members.

Maintenance-Free Living For many homeowners, particularly retirees and vacation property owners, HOAs provide peace of mind by handling exterior maintenance, landscaping, and common area upkeep. This can be particularly appealing for those who split time between multiple residences.

Consistent Community Standards HOAs establish and enforce rules that prevent issues like unkempt yards, inappropriate exterior modifications, or disruptive activities that could negatively impact the neighborhood's character and property values.

The Challenges of HOA Living

Monthly Fees and Special Assessments HOA fees can range from modest amounts to substantial monthly payments, depending on the amenities and services provided. Additionally, special assessments for major repairs or improvements can create unexpected financial burdens.

Restricted Personal Freedom HOA covenants, conditions, and restrictions (CC&Rs) can limit your choices regarding home modifications, landscaping, paint colors, and even lifestyle activities. Some residents find these restrictions overly intrusive while others find them comforting. 

Potential for Disputes Disagreements between homeowners and HOA boards can arise over rule enforcement, fee increases, or community decisions. These disputes can create stress and potentially costly legal battles.

A Closer Look at HOA Challenges in Our Region

Recent data reveals some concerning trends across our coastal region. According to the South Carolina Department of Consumer Affairs, Horry County leads the state in HOA complaints, accounting for 27% of all complaints filed in 2024. With 117 complaints filed, our county had more than double the number of the second-highest county.

Within Horry County, the complaints span across Grand Strand communities, with Myrtle Beach leading at 59 complaints, followed by Conway with 16 and Little River with 13. The Myrtle Beach Resort HOA received the most individual complaints with 4 cases. The primary issues driving these complaints throughout our coastal communities include:

Failure to adhere to and enforce covenants and bylaws
Concerns about maintenance and repairs
Ignored requests to access information or view documents
These statistics highlight the importance of thoroughly researching any HOA before purchasing a property within its jurisdiction.

Legislative Changes on the Horizon

Recognizing the growing concerns about HOA governance, South Carolina lawmakers are considering legislation that could significantly impact homeowner rights. House Bill 3180 is currently under consideration and would implement several important changes:

Foreclosure Protection: The bill would prevent HOAs from foreclosing on homes solely due to unpaid fines and fees, providing crucial protection for homeowners facing financial difficulties.

Accessible Dispute Resolution: By expanding magistrate court jurisdiction to include HOA disputes, the legislation would offer a more affordable alternative to circuit court proceedings, making justice more accessible to average homeowners.

Enhanced Transparency: The proposed legislation emphasizes increasing transparency in HOA operations and empowering homeowners through improved access to information and stronger enforcement mechanisms.

Improved Oversight: Lawmakers are studying comprehensive HOA oversight models from states like Georgia and North Carolina to develop more effective regulatory frameworks.

It's crucial to understand that deed restrictions remain legally enforceable even without an HOA structure.
