Why You Need Your Own Agent When Buying New Construction

Many homebuyers assume they don't need a real estate agent when purchasing new construction. This misconception can cost buyers thousands of dollars and leave them without crucial protection.

The most important thing to know when walking into a model home or visiting a new construction community is that the builder's agent works for the builder. They are contractually obligated to look out for the builder’s interest and they have a fiduciary duty to them, not you. Are builder’s agents bad? Absolutely not and I’ve had incredible experiences with (almost) all of them. But they could be fired and fined for breaking their contract with the builder by negotiating for you. 

The sales representative’s job at the model home is to sell homes at the highest possible price while protecting the builder's interests. You wouldn't use the opposing party's lawyer in a legal dispute – the same principle applies here.

What are the benefits of having your own agent? 

- Contract Review: New construction contracts are often heavily weighted in favor of the builder. Being able to navigate that contract and help explain the process is critical. We will review every detail and explain every confusing term so you can make an informed decision.


- Market Knowledge: Your agent brings expertise to help determine if the builder's pricing is competitive and whether you're getting a fair deal. They can research previously sold homes in the neighborhood and help navigate negotiations with the builder’s agent.

- Quality Control: During construction, we will accompany you to walk-throughs, identify potential issues, and ensure your punch list items are properly addressed.

- Negotiation Power: Many aspects are negotiable – from price and closing costs to upgrades and timelines. An experienced agent knows what can be negotiated and how to approach these conversations.

- Relationships: this one is important. We have relationships with builders agents and builders. We can leverage those relationships so you can be more successful. When we’re involved, builders know a steady hand will be at the wheel and we will ensure a professional approach to closing. 

Common Misconceptions:

"It Costs Me Extra": In every case we’re aware of, the builder pays our commission. Using your own agent typically doesn't increase your costs. You will not be able to negotiate a lower purchase price by not having your own agent. 

"New Homes Don't Have Problems": New construction can have defects, delays, and warranty issues. We will help ensure these problems are identified and resolved properly. We’ve done this a lot and we can help you jump through the hoops and hurdles of warranty claims and punch list items. 

Important Timing:

Most builders require that we be there the very first visit to the sales office or model home. Many builders require buyer representation to be established from initial contact. Visit alone first, and you may forfeit the right to representation later. That said, if you tell the builder’s agent that you are working with the Anderson Team, we typically can help moving forward.
